15050 (2009). Hon David Parker to the Minister for ACC: Has he or his officials proposed a new counselling regime for ACC sensitive claims, and if so, what are the financial projections that have been prepared for it?
Hon Dr Nick Smith (Minister for ACC) replied: While the final decision is being made it is not possible to cost any impact for ACC although additional staff are needed to support these improvements. The purpose of these changes has not been to achieve any financial savings.

15077 (2009). Lynne Pillay to the Minister for ACC: What sensitive claims are now pending with ACC that involve counselling for sex abuse victims and/or victims of domestic violence in Wairarapa?
Hon Dr Nick Smith (Minister for ACC) replied: Claims, commonly known as ‘sensitive claims’, receive cover under the ACC scheme when there is a significant mental injury as a result of certain criminal acts, dealt with in the Crimes Act 1961. Section 21 of the Injury Prevention, Rehabilitation, and Compensation Act 2001 (IPRC Act 2001) details the cover provisions for such claims. The twenty specific criminal acts covered by ACC are stipulated within Schedule 3 to the IPRC Act 2001. At the time that this answer was prepared, there were fifteen (15) sensitive claims, as per the above definition, pending a cover decision, from the Wairarapa region. Six of the fifteen have had a payment towards counselling costs recorded against the claim. ACC currently funds up to four counselling sessions per client so that a cover determination report can be provided.

Hon Dr Nick Smith (Minister for ACC) replied: Claims, commonly known as ‘sensitive claims’, receive cover under the ACC scheme when there is a significant mental injury as a result of certain criminal acts, dealt with in the Crimes Act 1961.
